1. Acceptance
By creating an account or placing a bid on The Coucou Club, you agree to these Terms & Conditions. If you do not agree, please do not use the platform.
2. Eligibility
You must be at least 18 years old to register. Buyers must confirm their phone number with a one-time code (sent to the account's email until text-message delivery is connected), add a payment method, and pass sanctions screening before placing bids. Identity verification is required only to bid for more than CHF 10,000 in total: leading bids, unpaid wins and purchases of the last 30 days together. Consignors must complete Stripe-hosted onboarding for payout eligibility.
3. Bidding
All bids are binding. Your card is checked when you save it; no amount is held when you bid. If you win, the winning bid and the buyer's premium are charged to that card after the sale closes; an order above CHF 10,000 is paid by bank transfer instead, within 5 business days. Bid sniping protection and minimum increments apply as set by the platform.
4. Consigning
Consignors grant The Coucou Club the right to list, photograph, and market submitted artworks for the duration of the consignment period (six weeks). Selling requires a yearly membership of CHF 250 (or 6 months for CHF 150 or 3 months for CHF 80), which includes the evaluation of your works. The Coucou Club charges a commission of 10% of the hammer price on successful sales. Reserve prices and estimates are set collaboratively based on independent valuation.
5. Payments & Payouts
Buyers pay the hammer price plus a buyer's premium of 5%, via verified payment methods through our payment processor. Consignor payouts are issued after the buyer confirms receipt of the artwork and any dispute window has closed. Payouts are made in the consignor's chosen currency.
6. Shipping & Delivery
Shipping is arranged by The Coucou Club or the consignor as agreed. All shipments are tracked and insured. Risk of loss passes to the buyer upon delivery confirmation by the carrier.
7. Disputes
If the artwork received is not as described, the buyer reports it before confirming delivery (delivery is confirmed for the buyer 14 days after it arrives). The consignor is not paid while The Coucou Club reviews the report, and if it agrees, the buyer is refunded and the return is arranged. Fraudulent claims may result in account suspension.
8. Limitation of Liability
The Coucou Club facilitates transactions between buyers and consignors. We do not guarantee the authenticity, condition, or value of artworks beyond the information provided by consignors and our curatorial review. Our liability is limited to the commission charged on any given transaction.
9. Governing Law
These terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of the Canton of Zurich.
