Terms & Conditions

Last updated: January 2025

1. Acceptance

By creating an account or placing a bid on RATART Auctions, you agree to these Terms & Conditions. If you do not agree, please do not use the platform.

2. Eligibility

You must be at least 18 years old to register. Buyers must verify their phone number, add a payment method, and pass sanctions screening before placing bids. Identity verification is required only for bidding above CHF 10,000 equivalent. Consignors must complete Stripe-hosted onboarding for payout eligibility.

3. Bidding

All bids are binding. When you place a bid, a payment hold is placed on your verified payment method for the bid amount. If you win, the hold is captured. If you are outbid, the hold is released. Bid sniping protection and minimum increments apply as set by the platform.

4. Consigning

Consignors grant RATART Auctions the right to list, photograph, and market submitted artworks for the duration of the consignment period (typically six weeks). RATART Auctions charges a commission on successful sales. Reserve prices and estimates are set collaboratively based on independent valuation.

5. Payments & Payouts

Buyers pay via verified payment methods through our payment processor. Consignor payouts are issued after the buyer confirms receipt of the artwork and any dispute window has closed. Payouts are made in the consignor's chosen currency.

6. Shipping & Delivery

Shipping is arranged by RATART Auctions or the consignor as agreed. All shipments are tracked and insured. Risk of loss passes to the buyer upon delivery confirmation by the carrier.

7. Disputes

If a buyer believes the artwork received does not match the listing description, they may raise a dispute within 48 hours of delivery. RATART Auctions will mediate in good faith. Fraudulent claims may result in account suspension.

8. Limitation of Liability

RATART Auctions facilitates transactions between buyers and consignors. We do not guarantee the authenticity, condition, or value of artworks beyond the information provided by consignors and our curatorial review. Our liability is limited to the commission charged on any given transaction.

9. Governing Law

These terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of the Canton of Zurich.
